Why STEM Entrepreneurs are the Perfect Candidates for the EB-2 NIW

Writer: G.E.B. GLOBALG.E.B. GLOBAL

The EB-2 NIW (National Interest Waiver) visa is an excellent path to a Green Card for entrepreneurs with Advanced Degrees or Exceptional Ability. It's particularly well-suited for those entrepreneurs in the STEM fields (Science, Technology, Engineering, and Mathematics). In this blog post, we'll explore how each STEM field can benefit the United States by leveraging the National Interest Waiver argument and why entrepreneurs in these fields should strongly consider applying for the EB-2 NIW visa.

Why STEM Entrepreneurs Make Great Candidates:

STEM entrepreneurs are well suited for the EB-2 NIW because, in determining whether, on balance, it would be beneficial to the United States to waive the requirements of a job offer, and thus of a labor certificate, USCIS considers the impracticality of a labor certificate and whether or not you will be self-employed in a manner that generally does not adversely affect the U.S. labor market.

Entrepreneurship in and of itself is self-employment and when an entrepreneur owns a majority share of a U.S. company, that type of control secures said self-employment, making it impractical for a labor certificate to be requested under the law. Pursuant Title 20 of the Code of Federal Regulations, Section 656.3, self-employed individuals are ineligible candidates for Labor Certification Applications inherent to a labor certificate (PERM) process.

Science:

Scientists play a crucial role in shaping the future of the United States by conducting groundbreaking research in various fields, such as medicine, biology, chemistry, and physics. Their work often leads to innovative solutions to pressing global challenges, such as climate change, public health crises, and food security. By contributing to advancements in these areas, scientists not only improve the quality of life for Americans but also create new job opportunities and drive economic growth.

Technology:

Technology professionals are responsible for developing and implementing cutting-edge solutions that enhance the way we live, work, and communicate. From artificial intelligence and cybersecurity to software development and data analysis, these experts help the United States maintain its competitive edge in the global market. By attracting top tech talent, the country can foster innovation, improve its infrastructure, and enhance its national security.

Engineering:

Engineers are indispensable in the United States, as they contribute to the design, construction, and maintenance of critical infrastructure such as roads, bridges, and energy systems. Their expertise also extends to fields like aerospace, automotive, and environmental engineering, where they develop advanced technologies and processes to improve safety, efficiency, and sustainability. By welcoming skilled engineers through the EB-2 NIW visa, the United States can build a stronger, more resilient nation for future generations.

Mathematics:

Mathematicians play a significant role in advancing various sectors, including finance, technology, and scientific research. Their skills in data analysis, statistics, and modeling are essential for making informed decisions, optimizing processes, and predicting trends. As a result, mathematicians can contribute to the growth and stability of the United States economy, improve healthcare outcomes through data-driven research, and help shape educational policies that foster a more skilled and competitive workforce.

Professionals in the STEM fields are uniquely positioned to make significant contributions to the United States, thanks to their expertise and the critical nature of their work. By pursuing the EB-2 NIW visa, STEM entrepreneurs can leverage their skills to benefit the country in areas such as the economy, culture, arts, education, healthcare, and infrastructure.

If you are a STEM entrepreneur seeking to advance your career and contribute to the United States' growth and development, we encourage you to explore the EB-2 NIW visa. Not only will you have the opportunity to make a lasting impact on the nation, but you'll also be one step closer to achieving your own American Dream.
